A Tuscaloosa woman among those injured in a catastrophic wreck in Thomasville on Tuesday has filed a lawsuit against the semi truck driver responsible for the collision.

According to a release from the law firm of Prince Glover Hayes, Nancy Calvert of Tuscaloosa sustained serious injuries when 45-year-old Andrii Dmyterko of Philadelphia, Pennsylvania, crashed his fully loaded semi-truck into several vehicles, including the red Nissan Rogue driven by Calvert, stopped at a red light on US Highway 43.

Calvert's Nissan Rogue flipped several times after the collision, skidding down the highway before coming to a stop upside down.

She was left hanging upside down, hanging by her seatbelt, and unable to get out of the vehicle. Calvert was rescued by two bystanders moments before her vehicle caught fire and burned.

The release from PGH states that Calvert views those who helped to free her as "heroes" whom she is eager to thank personally.

She was transported by ambulance to Grove Hill Memorial Hospital for treatment.

The Impacts of the Thomasville Wreck

Tuesday's wreck killed two people: 37-year-old Ashley Marie Springer McDonald and 53-year-old Woody Earl Beck III, an assistant football coach at Wilcox Academy.

The driver of the semi, Andrii Dmyterko, has been charged with two counts of vehicular homicide in connection with their deaths. The FBI has also joined local authorities in the investigation of the wreck.

The Lawsuit Against Dmyterko

The release from PGH states, "[Thursday's] lawsuit, likely the first of many involving this tragic collision, has been filed in Clarke County Circuit Court by Tuscaloosa attorneys Josh Hayes and Blake Williams of Prince Glover Hayes along with Grove Hill attorney and former state senator Marc Keahey of the Keahey Law Office."

The case has been filed against Dymertko, who was in the United States on a work visa at the time of the wreck, as well as the company for whom Dymertko was working, 4 US Transportation out of Chicago, Illinois, seeking "compensatory and punitive damages for the harm caused by [their] negligence, recklessness and wantonness."

“Widely circulated dash cam video of the crash shows no sign of the trucker applying his brakes before impact,” PGH Partner Josh Hayes said. “We are committed to fully investigating this matter and are confident that all the facts will come out.”
