
McFeeters’ Lawsuit Hits Tuberville Where He Lives
When Republican gubernatorial nomination candidate Ken McFeeters lost his challenge of Sen. Tommy Tuberville residency before the Alabama Republican Party Candidate Committee in February, he vowed it wasn't over. He has made good on the promise by filing a court challenge in Covington County Circuit Court. The suit names Tuberville and the Alabama Republican Party as defendants.

The Hoover insurance executive believes Tuberville lives in a multimillion-dollar beach home in Florida instead of a smaller home that he has listed as his residence in Auburn. That would make the senior Alabama U.S. Senator ineligible to serve as governor because he couldn't meet the seven-year residency requirement.
The lawsuit asks the court to require proof of Tuberville’s residency within seven days and requests an injunction to keep Tuberville’s name off the ballot if he is found to be ineligible.
The Tuberville gubernatorial campaign issued a statement after the lawsuit was filed, "“Ken McFeeters is desperately trying to save his joke of a campaign." the release states. "Coach Tuberville has lived in Auburn since 2019. When he isn’t representing Alabama in the U.S. Senate, he’s back home in Auburn with his wife Suzanne.”
Tuberville had no problems with the residency requirement to serve as Alabama's Senior U.S. Senator because the only residency requirement is to be a citizen of the state represented at the time of taking office. That has been the requirement since the Constitutional Convention in 1787.
The presumptive Democratic Party gubernatorial nominee, Doug Jones, earlier this month stated that he considers Tuberville's residency a "serious issue for voters" to consider. Jones has signaled that he has no plans to challenge Tuberville's eligibility.
The Republican Party primary elections are scheduled for Tuesday, May 19, 2026.
